The rules changed in 2025.
Italy changed the rules for citizenship by descent in 2025. Decree-Law 36/2025, converted into Law 74/2025, limits automatic citizenship for people born abroad who hold another citizenship, with exceptions, for example when a parent or grandparent holds only Italian citizenship. Applications filed by March 27, 2025 are assessed under the earlier rules.
Confirm your eligibility with the Italian consulate or an Italian citizenship lawyer before you order documents. An apostille does not make anyone eligible. We do not give immigration or legal advice.
What usually needs an apostille.

Birth certificates
Certified copies for each person in the line, apostilled by the state that issued them.

Marriage certificates
Certified copies from the county or state that recorded the marriage.

Certified copies, when someone in the line has died.

Divorce decrees
Certified copies from the court, when a marriage in the line ended in divorce.

Naturalization records
The Italian ancestor’s naturalization records, or proof they did not naturalize. Who authenticates them depends on who issued them: court records go to the state, and federal records to the U.S. Department of State.

The Italian consulate asks for U.S. vital records to be translated into Italian, and it does not provide translations. The apostille itself does not need to be translated.

Residents of Missouri and Kansas apply through the Consulate General of Italy in Chicago. Check the consulate’s current checklist, appointment system and document rules before you order apostilles, because a record that is too old or in the wrong form can be refused.

Does an apostille guarantee that my application is accepted?
No. The apostille only authenticates the U.S. record. Eligibility and the decision belong to the Italian authorities.
Which state apostilles my grandparent’s birth certificate?
The state that issued it, wherever you live now. A file often includes records from several states, and each goes to its own Secretary of State.
Do Italian records need an apostille?
No. Apostilles are for U.S. documents used in Italy. Italian records come from the comune or parish in Italy.
A name is spelled differently on two records. Can you fix it?
No. Corrections are made by the office that issued the record. Ask the consulate whether a difference matters before you order apostilles.
